TERMS & CONDITIONS

Welcome to "Treasures of Piemonte Food and Wine Adventures LLC" website.  This website is provided help travelers look into what our Italian adventures are all about and to assist customers in selecting a date for their adventure.  We carefully craft a personalized adventure like no other.  The terms "we", "us", "our", and and “T.O.P. Food and Wine Adventures" refer to Treasures of Piemonte Food and Wine Adventures LLC, a Texas limited liability company. The term "you", “customer”, or “the traveler” refers to the customer visiting or using our website and booking a reservation through this website.

 

1. Registration and Payment

A deposit of 50% is required at the time of booking. Payment can be made with credit card, personal check, or wire transfer (if available) at the time of booking.  The balance is due 120 days prior to departure.  Within 120 days of departure, the entire cost of the trip must be paid at the time of confirmation.

 

2. Cancellation

Cancellations of a confirmed reservation 120 days or more prior to the start of the tour are subject to a $250 per person fee.  This fee is meant to cover any administration costs or credit card charges incurred.  If there are any additional charges incurred for hotels or any activities associated with the itinerary that are non-refundable at that time, those charges will also be added to the $250 cancelation fee.  Cancellations 91-119 days will be subject to loss of 50% of trip price. Cancelations 90 days from the tour date will be subject 100% non-refundable fee.

 

3. Insurance

We strongly recommend the purchase of trip cancellation insurance, which is available for coverage of expenses in the event of trip cancellation due to illness or accident.  In the event that you must cancel your tour, trip cancellation insurance might be the only way to get reimbursement. It is also recommended that the customer obtain baggage insurance.  Treasures of Piemonte Food and Wine Adventures LLC does not sell travel insurance. Please use a reputable source for such insurance. 

 

4. Passports and Visas

Valid passports with 3 months of validity remaining (we recommend 6 months) are required for travel to most European destinations. There are no visa requirements at this time to travel into Italy and other EU countries.  In compliance with Schengen regulations, non-EEA nationals are restricted to a maximum of 90 days within a continuous 180-day period, either without a visa or with a multiple-entry Schengen visa. Please review the website below for more details if you plan to spend additional time in Europe or have already spent time in Europe prior to your trip with us. 5. Baggage

Check with the airline for any baggage restrictions applicable to international flights or other flights you may be taking internally to the country. Baggage and personal effects are at the owner’s risk throughout the tour. Please try to keep the luggage to medium size suitcases.  Space in the transport vehicles may be limited.

 

6. Changes

Prices are based on the current rate of exchange rate between the Euro and the US dollar. Treasures of Piemonte Food and Wine Adventures LLC reserves the right to increase the price of the tour to cover such potential increases in this exchange rate.  Items that may cause such increases could

be related to increased hotel rates, cost of meals, and/or cost of transportation. Treasures of Piemonte Food and Wine Adventures LLC also reserves the right to cancel any tour or to make any changes in the itinerary that are due to circumstances beyond its control.  We also reserve the right to make changes to the proposed itinerary or switch activities from one day to another due to circumstances unseen or beyond Treasures of Piemonte Food and Wine Adventures control or due to issues with obtaining reservations on given days.  We will do our best to run the tour as planned, but please be flexible as changes can occur even after the final itinerary has been issued.  We will communicate if/when any changes occur.

 

7. Promotional Photography

Treasures of Piemonte Food and Wine Adventures reserves the right to take photographs during the any portion of the tour and use them for promotional purposes.  By booking a reservation with Treasures of Piemonte Food and Wine Adventures, customers agree to allow us to use such photos. If you do not wish to have your image used in such a way, please let us know before the tour starts.

 

8. Claims and Refunds

Refunds will not be given for any missed events on your itinerary except for extenuating circumstances.  If you feel that you should get any sort of refund due to missed events, please submit such claims in writing within 45 days of the end of the tour.  You must include any documentation verifying the claim.  Any refund or revision to the price of the tour being considered will be based on the actual price of the event involved.  Adjustments will not be made for unused sightseeing trips or meals. If the claim is not made within 45 days from the end of the tour, Treasures of Piemonte Food and Wine Adventures LLC will not accept any liability.

 

9. Air Transportation

Its is up to the customer to ensure their correct arrival and departure flight information so that they are present at the start of the tour and can be moved on to their next destination at the end of the tour.  Treasures of Piemonte Food and Wine Adventures LLC will not accept any responsibility for mistakes or errors in airfare bookings that prevent the customer from participating in all or any part of the tour.  

 

10. Limits on Responsibility

Treasures of Piemonte Food and Wine Adventures LLC, does not own or operate any of the enterprises that provide goods or services for the tour.  We arrange all transportation, lodging, dining, and other services from numerous independent providers.  The providers of these services are independent contractors so, as a result, Treasures of Piemonte Food and Wine Adventures LLC is not liable for any negligence or willful act of any such person.

 

Treasures of Piemonte Food and Wine Adventures LLC acts solely as a coordinator for the customer to ensure they have transportation, hotel accommodations and other tour arrangements. In that capacity, Treasures of Piemonte Food and Wine Adventures LLC will exercise all reasonable care possible to ensure the customer’s safety and that they are satisfied with the tour.  However, Treasures of Piemonte Food and Wine Adventures LLC does not assume or bear any responsibility or liability for any injury, death, damage, loss, accident, delay, or irregularity arising in connection with the services of any airplane, train, boat, automobile, or other conveyance, or the actions of any third-party involved in carrying the traveler or in affecting these tours.  

Treasures of Piemonte Food and Wine Adventures LLC is not responsible for damages, additional expenses, or any other losses due to cancellation, delay or other changes in air or other services, sickness, weather, strike, war, civil disturbances, acts or threats of terrorism, travel warnings or bans, termination or suspension of war risks or other carrier insurance, quarantine, acts of God or other causes beyond its control. All such losses must be borne by the traveler, and tour rates provide for arrangements only for the time stated.

Treasures of Piemonte Food and Wine Adventures LLC is not responsible for delays, changes or cancellation costs due to incorrect, incomplete or expired traveler documents. In the event of cancellation, delay or rescheduling mandated by any of the aforesaid causes beyond Treasures of Piemonte Food and Wine Adventures LLC control, the customer shall have the option of accepting in lieu of the original tour such rescheduled tour or other substituted tour(s) as may be offered, or else, receiving a refund of as much of such advance tour expenditures as Treasures of Piemonte Food and Wine Adventures LLC can recover on the traveler's behalf from carriers, third-party tour vendors, etc., but, Treasures of Piemonte Food and Wine Adventures LLC shall not have any obligation or liability to the traveler beyond the foregoing.

Treasures of Piemonte Food and Wine Adventures LLC reserves the right to make alterations to the tours itinerary and to substitute hotels, vehicles, boats, or activities if this is required. Treasures of Piemonte Food and Wine Adventures LLC reserves the right to cancel, delay, or reschedule any tour prior to departure, and, so long as this is not due to any of the aforesaid causes beyond our control, the customer shall be entitled to a full refund of all monies paid to that point if he/she so desires, less any non-refundable deposits or uncollectible expenses incurred.

 

In addition and without limitation, Treasures of Piemonte Food and Wine Adventures LLC is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

 

Risks: There are certain inherent risks in traveling to any part of the world. These include, but are not limited to, hiking or walking or injuries due to altitude sickness.  The customer assumes all such risks with regard to these possibilities.

 

Travel Advisories/Warnings: It is the responsibility of The Traveler to become informed about the most current travel advisories and warnings by referring to the U. S. State Department's travel website at www.travel.state.gov/ or by phone at 1-888-407- 4747.  In the event of an active State Department Travel Warning against travel to the specific destination location(s) of the trip, should the traveler still choose to travel, notwithstanding any travel advisory or warning, The traveler assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.

 

COVID-19: As a result of the spread of the coronavirus (Covid-19), governments and travel suppliers (including airlines, hotels, restaurants, guides and tourist attractions) have implemented health, safety, hygiene, security and other measures to be followed before, during and after your trip (collectively, the “Covid Measures”). As a result of Covid-19 and/or the Covid Measures, you and other travelers may experience, without limitation, (i) extended wait-times and other travel delays; (ii) shortening, prolonging, or cancelling your trip or trip excursions, not gaining entry to your destination country or certain tourist attractions, and/or returning home unexpectedly; and (iii) unexpected costs associated with Covid-19 testing and other Covid Measures, hospital stays, medical treatments, cancellations or change charges relating to your trip excursions, early cancellation or extended trip charges, as well as in-destination and home-country quarantine protocols. Because Covid Measures change day-to-day and from country to country, the preceding risks and costs associated with Covid-19 and the Covid Measures are not intended to be exhaustive. You acknowledge (for yourself and on behalf of your traveling companions that have booked a Treasures of Piemonte Food and Wine Adventures LLC trip through or by you), that you will comply with, and will cause your traveling companions to comply with, all Covid Measures, and will do so at your cost and risk. For greater certainty, you agree that all costs associated with Covid-19 and complying with Covid Measures, including those set out above, have not been included in, and are in addition to, your trip price and you are fully responsible for, and shall pay, same. You (for yourself and on behalf of your aforesaid traveling companions and each of your and their family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives) covenant not to sue and release, waive and discharge Treasures of Piemonte Food and Wine Adventures LLC from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by you or your aforesaid traveling companions related to COVID-19, or similar virus. Covid Measures are generally updated frequently and are typically set out on government and travel supplier websites. We recommend that you visit these websites frequently before and during your trip.

 

Arbitration Agreement: Any controversy or claim arising out of or relating in any way to these Terms and Conditions, to the Responsibility Clause, to the brochure, or any information relating in any way to the trip, or to the trip itself, shall be settled solely and exclusively by binding arbitration in Texas, US, in accordance with the rules of the Arbitration Association then existent.

 

Travelers Representations: The traveler represents that neither he nor she nor anyone traveling with him or her has any physical or other condition or disability that could create a hazard to himself or herself or other members of the tour. Treasures of Piemonte Food and Wine Adventures LLC reserves the right to decline to accept anyone on a trip. Treasures of Piemonte Food and Wine Adventures LLC reserves the right to remove from the trip, at his or her sole expense, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip.
